The office of Marilyn Mosby, the "activist" Baltimore state's attorney who charged the six officers involved with the death of Freddie Gray, denies that she favorited two incendiary tweets regarding the case, claiming instead that her Twitter account was hacked.
This week it came to light that Mosby had "favorited" two tweets on May 6 that appear to be further evidence that she should not be overseeing the Gray case. The Daily Caller reported Wednesday that Mosby favorited a tweet referring to "those 6 THUG cops" and another that praised Mosby for being a person who "INFURIATES a certain kind of white person."
Wednesday Fox News' Megyn Kelly reported that Mosby's office is now claiming that "both Mosby’s official Twitter account and her personal account were hacked," adding, "We do not know how long it's been going on, we are working with Twitter."
Kelly reported that while Mosby did tweet on May 23 that her government account was hacked last week, there's been no indication that her personal account was hacked weeks before. The host pushed back against the claim, noting that the alleged hacking took place several weeks ago and that favoriting two tweets would be an odd action for a hacker.
Regardless of the truth of the hacking claim, Kelly and guest Kimberly Guilfoyle, a former San Francisco Assistant DA, suggested that the degree of bias that Mosby has already shown publicly was evidence enough that her role in the case is problematic. Guilfoyle condemned Mosby's actions involving the case as "highly improper and unethical" due to her "activist" approach:
GUILFOYLE: This is an activist in my opinion. She is supposed to be an impartial evaluator of the facts of the case.
As some of the evidence of her bias, critics of Mosby point to her activist-esque announcement of the charges against the six officers on May 1, in which the state's attorney told Black Lives Matter protestors that she had "heard your call for 'No Justice, No Peace'" and described the moment as "your time."
The legal representation for the six cops has called for Mosby to recuse herself and has filed a motion to change the venue of the trial, arguing that a fair trial in Baltimore under Mosby's leadership is now impossible. TheDC reports:
Attorneys for the six charged cops have cited Mosby’s statements in several court motions filed this month. They have filed a motion to dismiss the case, as well as another one, and called on Mosby to recuse herself. In that motion, the lawyers claimed that Mosby is biased and has numerous conflicts of interest. The attorneys acted again on Wednesday by filing a motion for a change of venue. In the 85-page complaint, the attorneys claimed that it will be impossible for the six officers to get a fair trial in Baltimore.
