New York Yankees fan Andrew Rector, 26, is suing his favorite team, ESPN and two of its announcers for "emotional distress" because he claims they made him feel like a "fatty" for showing him sleeping during the 4th inning of a Yankees/Red Sox game on April 13. Rector is suing for $10 million in damages.
Rector filed the lawsuit July 3, according to The Smoking Gun. The lawsuit targets ESPN announcer Dan Shulman for commenting that Rector looked "oblivious" while sleeping during the game, as well as John Kruk who said the ballpark was "not the place you come to sleep.” In the video posted to MLB.com, you can hear the two announcers having a little more back and forth between themselves about the sleeping fan -- commenting about how comfortable he looks, or about the guy sitting next to him, and also wondering if he slept through the previous crowd-pleasing home run.
However, Rector says he was bombarded with an "unending verbal crusade" and an "avalanche of disparaging words" by Kruk and Shulman. Rector also says that comments posted to the video are also to blame. Words like "fatty, stupor, unintelligent, stupid" were used in the online comments. Amazingly, Rector attributes those words to the ESPN announcers -- words they definitely did not say.
Those named in the lawsuit are Major League Baseball Advanced Media, ESPN New York, New York Yankees, Dan Shulman, and John Kruk. Read the lawsuit here.
