Democratic presidential candidate Martin O'Malley said that children born in the United States to illegal immigrant parents shouldn't be denied a birth certificate because he claims "citizenship is a human right."

This declaration was made in light of the lawsuit filed on behalf of 23 children of 19 illegal immigrant parents and against the Texas Department of State Health Services because they haven't issued birth certificates as the parents are unable to provide proper forms of identification. 

O'Malley took issue with the Texas health department's actions saying:

[D]enying birth certificates to US citizens is not only outrageous, it’s unconstitutional.

The 14th amendment of the US Constitution could not be clearer. It states that ‘all persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside,’” he said. “The Texas Department of State Health services should cease this discriminatory and unconstitutional practice immediately. Citizenship is a human right.

As PJ Media points out, it is O'Malley that proposes a plan to fix America's "inhumane" immigration policies, which would include detaining only "those who pose a clear threat to public safety or national security." Besides as O'Malley states, "the enduring symbol of our nation is the Statue of Liberty, not a barbed wire fence."
