Actress Sofia Vergara and ex-fiancé Nick Loeb are in a battle over what is to happen to two frozen embryos created through in-vitro fertilization while they were a couple. Though legal paperwork was signed, Loeb says there was nothing included that addressed what to do with the embryos if the pair split up.

Appearing on NBC's Today, Loeb reiterated what he recently wrote in a New York Times op-ed: "In my view, keeping them frozen forever is tantamount to killing them."

Speaking with Today's Hoda Kotb Thursday, Loeb said:

This has to do with really moral, legal, and ethical concepts that are out there about lives that we've already created.

Much of the advice that is coming Loeb's way is requesting him to move on. Even Vergara has stated as much. She became engaged to another man months after splitting with Loeb.

Kotb asked if he truly wants to be a father, as he stated in his op-ed, or is it that he wants a child with Vergara. Loeb told Kotb, "It has nothing to do with her baby or a baby; lives were already created."

"I wouldn't just toss them aside, no different than a child that had been born," he added.

Vergara insists that the legal papers indicate that nothing can happen to the two female embryos unless both she and Loeb consent to a final decision. And though she has complained about Loeb airing their private affairs, Vergara appeared on ABC's Good Morning America Thursday to make it clear that she neither wants the embryos destroyed nor carried to term. She also complained that the press has given Loeb an outlet when he is not even famous.

"He’s not an actor. He’s not a celebrity. It’s like, why? Why are they allowing him to do that?” Vergara asked.

Despite allegations that Loeb is motivated financially to bring this matter to light at a time when Vergara's career is exploding, he insists that it is the lives of the two frozen embryos that are his main focus. He told Kotb that he would be willing to allow Vergara and her new fiancé, actor Joe Manganiello, to raise the two girls, as long as he had joint custody. 

Loeb explained:

I've offered for her to waive all financial responsibilities, I'll financially pay to raise this child, put it through college. I mean, I can give these children a wonderful life. These girls will be raised knowing that they had a father who fought so hard for them, that they'll know they'll be loved so much.

There's nothing I want to do more than bring these children to life. I mean, they've already got lives, they're on a journey and a pathway to being born. Why go the other way? We're talking about equal rights. Why err on the side of death? We should be always erring on the side of life. Especially when lives have already been created.
