David Depuydt, an Arizona charter school teacher, pleaded guilty to sexual assault charges carried out over seven months against a 15-year-old student. The teacher, 29, was sentenced in September to 10 years in prison, placed on lifetime probation and must register as a sex offender, according to The Arizona Republic.
Now, the girl's parents have filed a civil suit against Horizon Community Learning Center, near Phoenix, for "mishandling the situation" in allowing sensitive information to spread throughout the school, identifying their daughter and ultimately subjecting her to endless ridicule from other students. The horrifying ordeal, including Depuydt trying to perform an abortion with a metal ruler, and endless taunts of "slut" and "whore" from her peers, drove the young girl to attempt suicide.
According to court documents provided by Courthouse News Service, Jane Doe's lawsuit cited multiple instances of sexual misconduct at the hands of Depuydt inside a school bathroom, inside his classroom, inside his car, and at an apartment complex. Doe states that she was younger than 15 when it all began. From the lawsuit:
Depuydt utilized his inherent authority, trust and position as a teacher and community service project supervisor to target Jane Doe based on her gender and subject her to multiple instances of illegal sexual harassment and discrimination.
Doe said that Depuydt "repeatedly sexually assaulted and raped her."
Once an investigation began, the school suspended Depuydt without pay. The day after his arrest, the school issued a public letter informing parents and students of the Depuydt's arrest and that his victim was a student. The civil complaint states that the information in the school's announcement was enough to identify the girl and for news and gossip to spread quickly amongst the students. It also charges that other school staff witnessed Depuydt leaving the school bathroom with Doe, leaving the school together, and seeing the two together outside of school hours, even "hours before his arrest."
The lawsuit states:
The charter school and its administration failed to take effective action to prevent the sexual harassment and sexual assault of Jane Doe by defendant Depuydt.
Lawyers from the family are seeking punitive damages, including negligent supervision and intentional infliction of emotional distress, Courthouse News reports.
