On Wednesday, Guam's attorney general ordered government officials to start processing same-sex marriage licenses.

"Attorney General Elizabeth Barrett-Anderson's instructions came two days after a lesbian couple filed a legal challenge to the territory's marriage laws after they were barred from submitting an application for a license to wed."

But not so fast.

The acting director of the Department of Public Health and Social Services, Leo Casil, told the Pacific Daily News that the government won't accept applications "until further notice." Casil said he merely received a letter on the issue from Barrett-Anderson, not a legal opinion.

Governor Eddie Baza Calvo released a statement saying, "While this current legal issue is being reviewed, if it is the will of the people of Guam to make same-sex marriage legal on Guam, then the Guam Legislature, the people of Guam's representatives, can take action to change the law, or a referendum can be held giving the people of Guam a direct voice in this issue."

Attorney General Barrett-Anderson said the basis of her decision was a 9th Circuit Court of Appeals. The court ruled state bans on gay marriage as unconstitutional back in October.

Guam would be the first U.S. territory to allow same-sex marriage. Right now, a case in Puerto Rico is challenging the country's law defining marriage as between a man and a woman.  The 1st Circuit Court is waiting for the Supreme Court to rule before it hears oral arguments in Puerto Rico case.
