Border agent Chris Cabrera told Fox News’ Neil Cavuto Wednesday that even self-admitted gang members and criminals from Central America—including those who have committed murder—are being allowed to remain in the country due a to a current loophole that simply requires illegal immigrants to say they have family in the U.S. and none back home. Regardless of the immigrant’s background, Cabrera said, “we release them into our country.”

After Cavuto played the clip of an agent telling a man at the border that citizenship in the U.S. was now irrelevant, he asked Cabrera whether that was a fair representation of the mood of agents. Cabrera said that morale among border patrol agents was at “an all-time low” because they were being prevented from doing the job “they were hired to do.”

The reason was a current “loophole” applying to immigrant minors and the massive increase in illegal immigrants. The loophole allows immigrant minors, regardless of their background, to be released if they supposedly have family in the U.S. and none in their home country.

“Even if he is a confirmed gang member, a confirmed criminal, even by self-admission, we for some reason don’t send them back to their home country — we release them into our country,” Cabrera said, adding that “nine times out of ten” minors are allowed to remain the U.S.
